  Arrest of Ship

arrow Arrest of ship is a measure usually taken by the interested parties to obtain the security from the shipowners.

arrow Procedures
a The claimant shall file an application in writing with the competent court;
b The claimant will usually be required by the court to provide a counter security. In the absence of a satisfactory counter security, the Court may not accept the application or dismiss the application (if it has been accepted);
c The ship arrest order shall be issued by the court within 48 hours after having accepted the application.

arrow After the ship is arrested, the registered shipowners and/or the bareboat charterers of the arrested ship shall provide a proper security as demanded by the claimant, failing which there is risk for the arrested ship to be auctioned.

arrow Time Limit
The time limit for ship arrest is 30 days. Where the claimant brings a lawsuit or applies for arbitration within the 30 days, or where the claimant applies for ship arrest in the process of litigation or arbitration, the period of ship arrest is limited by the said 30 days.

arrow Risks
The claimant who has wrongly applied for arrest of ships shall indemnify the interested party for the losses incurred thereby.
